1. Purpose
These Terms and Conditions govern access to and use of the website of María Fernanda Rodríguez ("the Site"), as well as the relationship between the user ("the User") and María Fernanda Rodríguez, Immigration Agent ("the Advisor"), regarding immigration advisory and support services offered in Colombia.
Using the Site implies full acceptance of these Terms and Conditions. If the User does not agree with them, they should refrain from using the Site or contracting the services offered.
2. Nature of the services
The services offered consist of advisory, guidance, document preparation, and support in immigration processes before the competent authorities in Colombia, including the Ministry of Foreign Affairs (Cancillería) and Migración Colombia. These services include, among others: migration profile analysis, document preparation and review, visa processing, process follow-up, right-of-petition filings, reconsideration, appeal and complaint remedies, and guidance on tutela actions in immigration matters.
The Advisor provides a professional guidance and support service. The final decision on the approval, denial, or processing of any visa or immigration process rests exclusively with the competent Colombian immigration authority, so contracting the advisory service does not, under any circumstance, guarantee the approval of a visa or any other immigration process.
3. Informational nature of the Site's content
The content published on the Site, including blog articles, is general and informational in nature. It does not constitute personalized legal advice and does not replace an individual consultation about each User's specific case. Immigration requirements, timelines, and conditions can change and vary depending on each person's particular situation; therefore, the User must verify current information and, if necessary, contract personalized advice before making decisions or filing applications.
4. User obligations
The User agrees to provide truthful, complete, and up-to-date information when requesting information or contracting services. The Advisor will not be responsible for consequences arising from false, incomplete, or inaccurate information provided by the User, including requirements, inadmissions, or unfavorable responses from the immigration authority.
5. Fees and payment
Fees for advisory services are agreed individually with each User, according to the complexity and scope of the immigration process, and are communicated prior to the provision of the service. Any payment made corresponds to the provision of the advisory and support service, not to the outcome of the immigration process, which depends on the competent authority.
6. Intellectual property
The texts, articles, logos, graphics, and other content on the Site are the property of María Fernanda Rodríguez or are used with due authorization, and are protected under Colombian copyright and intellectual property law. Their reproduction, distribution, or commercial use without prior express authorization is prohibited.
7. Links to WhatsApp, email, and Instagram
The Site includes direct links to external contact channels (WhatsApp, email, and Instagram) to facilitate communication with the Advisor. Use of these platforms is additionally subject to the terms and privacy policies of each provider (Meta/WhatsApp, Google, Instagram), over which the Advisor has no control.
8. Limitation of liability
The Advisor will not be liable for damages arising from: (i) immigration decisions made by the competent authority; (ii) regulatory changes occurring after the Site's content was published; (iii) interruptions, technical failures, or temporary unavailability of the Site; or (iv) misuse of the Site by third parties.
9. Modifications
The Advisor may modify these Terms and Conditions at any time to reflect changes in the services offered or in applicable regulations. Modifications take effect upon publication on the Site.
10. Governing law and jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Colombia. Any dispute arising from their interpretation or enforcement will be resolved before the competent Colombian judicial authorities.
